The case arose from a long-running dispute between Gunawan’s Makindo company and businessman Toh Keng Siong, which dates back to a partnership agreement signed over two decades ago.
In a recent story, we mentioned that Gunawan Jusuf Sugar and several other parties had filed a pre-trial case at the South Jakarta District Court against the National Police’s Criminal Investigation Unit (Bareskrim). The case stemmed from a long-running feud between Gunawan’s Makindo group and businessman Toh Keng Siong. Gunawan Jusuf Sugar initially filed the complaint but later withdrew it, only to re-file it a few days later. However, on October 8, 2018, Gunawan Jusuf Sugar withdrew the complaint once more. Toh Keng Siong’s legal counsel filed a complaint with the Judicial Commission as a result of the repeated withdrawals.
On December 5, 2017, the South Jakarta District Court filed a pre-trial case. The complaint was filed against the General Crimes Directorate of the National Police’s Criminal Investigation Unit (Bareskrim) by two individuals, one of which was sugar tycoon Gunawan Jusuf. The case concerns Bareskrim’s inquiry, which was based on a police report made by PT Bumi Sumber Sari Sakti, a company owned by Bambang Trihatmodjo, the late President Soeharto’s first son.

The Police investigator (SP3) stopped investigating his allegation on July 20, 2004, because it was not considered a crime. Between 1999 and 2001, Toh Keng Siong spent a total of US$126 million on Makindo, a corporation owned by Gunawan Jusuf Sugar.
After refusing to accept the case’s conclusion, Keng Siong filed a pretrial complaint at the South Jakarta District Court in 2008. He also won the lawsuit, and the National Police were forced to continue their investigation into Gunawan Jusuf’s alleged fraud.
However, the National Police Legal Division filed a judicial appeal of the South Jakarta District Court’s ruling in favor of Toh Keng Siong five years later, in 2013.

A team led by the Deputy Attorney General for General Crime at the Attorney General’s Office (AGO) has been waiting for Gunawan Jusuf’s case file for more than a year. In mid-December 2016, the Indonesian Police’s Criminal Investigation Unit informed prosecutors via a criminal investigation starting notification letter (SPDP) that they were investigating the Sugar Group’s CEO for alleged theft and money laundering.

In August 2018, Toh Keng Siong reported Gunawan Jusuf Sugar in a case of fraud and suspected money laundering (TPPU). Gunawan Jusuf Sugar was the one who had to go into hiding. In South Jakarta District Court, he filed a preliminary action. The goal is to have his status as a reported witness revoked or annulled.
The pretrial request will also be considered by the South Jakarta District Court. The Gunawan Jusuf Sugar money laundering and fraud case have been reopened for further debate.
