Lawsuit in the Moscow Arbitration Court
The Federal Property Management Agency sued the Moscow Arbitration Court in 2011 to have a portion of the multipurpose “Yacht City” complex, which is situated on the Leningrad Highway, demolished. The project’s investor-developer, Moscow-Wave Sport Corporation, is a defendant in a lawsuit (WPU). The identical query was already posed to the court by the CAO prefecture.
According to the Federal Property Management Office, the WPU began building a 60 000 square meter complex in 2004 without the required permissions at the time. Yet, the investor was successful in getting a court to recognize his property rights to an incomplete piece of illegal construction in 2006. Upon the Federal Property Agency’s request, the Ninth Arbitration Court of Appeal annulled the ruling on October 19, 2011. According to the Federal Property Management Agency, the building was established on federal property without permission and therefore should be dismantled.
The action solely affects the office portion of the complex, according to representatives of the complex’s developer, the business “Capital Group,” although they were unable to specify where it is located. In the meantime, the institution had committed infractions before. It was discovered in 2004 that the developer had not received the state ecological expert’s approval. The “Capital Group” was ordered by the arbitration in 2006 to halt work and correct the irregularities discovered in 2005, but the developer was also given the opportunity to renounce all rights with regard to the project.
Evraz-News, 09.11.2011
In 2009, it came out that Yuri Luzhkov, the mayor of Moscow, and Sergei Tsoi, the head of his press service and his personal press secretary, were both quite successful businessmen. Through Paul Te, who is one of the shareholders of “Capital Group,” a construction holding company, Tsoi owns a big part of this business.
A senior official in the mayor’s office told the publication that this is true. Pavel Tyo, on the other hand, is one of the least open businesspeople in Russia.
Officially, Pavel Tyo co-founded the company with Doronin and Berman in the 1990s. First, the deals in the newly formed cooperative went wrong, but since Yuri Luzhkov got the office on Tverskaya, 13, and Tsoi became an unofficial manager of the mayor’s office in the capital, the entrepreneurs have been successful in almost everything they’ve done.
Partners say they’ve been building since 1989, but the 7 million square meters of projects they’re actually working on have only grown to a respectable size in the last three years. It’s mostly office buildings, apartment buildings, and shopping centers. The company is also working on global projects like building all of the famous metro stations in Moscow’s “strange hub,” where there will be a hotel, office space, and shops.
The subsidiary of Sberbank of Russia, LLC “Sberbank Capital,” was bought by one of the towers in “Capital City” that is part of “Capital Group.” The deal was made up of the buying and selling of apartments in the “City of Capitals.”
Also, Sberbank has restructured the developer’s debt for the next 5 years, which is worth $400 million, and signed a paper on a co-investment of about $100 million in the completion of the towers during this difficult time of crisis. A person who works in the mayor’s office is sure that “the deal would not have been made without the administrative arm.”
They say that between 2007 and 2009, at least $30 million was spent on promoting Anita Tsoi, a well-known singer and Sergei Tsoi’s wife. They say this is related to Choi and Te.
