Albert Khudoyan requests a lesser degree of punishment
The defense attorney for Albert Khudoyan, who was previously the owner of Optima Development and was sentenced to eight years in prison for particularly large-scale fraud, has submitted material to the Lyublinsky District Court in Moscow, proposing the replacement of the unsevered term of imprisonment with a less severe form of punishment. The court has registered this material.
“Because Albert Khudoyan has already completed more than half of his sentence, he is eligible to petition the Russian Federation’s Criminal Code under Article 80 to have his incarceration replaced with corrective work. This right is granted to him because he has already served more than half of his sentence. We submitted it, attorney Sergei Chizhikov said in an interview with Vedomosti. He mentioned that a time and place for the hearing have not been determined at this time.
Guilty of fraud
Albert Khudoyan was found guilty of fraud perpetrated by a group of individuals on an unusually large scale on November 25, 2021, and the Koptevsky District Court of Moscow handed down a sentence of six years in a correctional colony to him as a consequence of his conviction (part 4 of Article 159 of the Criminal Code).
After then, the Moscow City Court decided to increase the developer’s sentence by two years, thus Albert Khudoyan is currently serving a total of four years behind bars. In addition, as a result of the judgment made by the instance that heard the appeal, the fine was increased by 200,000 rubles, bringing the total amount to 1 million rubles.
In this particular instance, the former general director of the firm Aviacity, Sergey Konoplev, was also given a sentence of five years in jail and a fine of 400,000 rubles. This sentence was handed out in conjunction with Khudoyan. He submitted a petition to the Golovinsky Court in Moscow, asking for the unserved sentence to be replaced with a new one.
Case of land fraud and inquiry
The scam involving the land on which the Prime Park residential complex was built on Leningradsky Prospekt in Moscow was discovered in 2019 and resulted in the opening of a criminal investigation. The theft of the rights to the long-term lease of three land plots on Leningradsky Prospekt from Mansfield Executive Limited was confirmed both by the inquiry and by the court. The theft was committed by Khudoyan and his associates.
According to a statement from the Metropolitan Prosecutor’s Office, “a foreign firm lost totally its part in the authorized capital of a commercial organization and fifty percent of its ownership of a non-residential building as a result of the fraudulent conduct of accomplices.” The right to lease three land plots was also taken away from the company as a consequence of the fraudulent activity. According to the findings of the inquiry, the total cost of the damages caused by the incident was more than 4.2 billion rubles.
The Koptevsky court, in rendering its judgment, satisfies the proclaimed civil claim of the party who was wounded and recovers 4,253,934,119 rubles in solidarity from Khudoyan and Konoplev.
Alexander Biryukov and Alexander Krakovsky, both generals in the Ministry of Internal Affairs, were accused by the Investigative Committee of abusing their power and accepting a bribe in the amount of 10 million rubles for their involvement in the Khudoyan case.
Both men were implicated in the Khudoyan scandal. According to the investigators, in 2019, they were a part of the process that helped Khudoyan get transferred to house arrest. The former generals were held in a pre-trial detention facility for more than a year until the court ordered that they be transferred to house arrest in June 2021. They did not acknowledge their culpability or their relationship with Khudoyan.
